Force Majeure
-
In this Agreement ‘force majeure’ means any cause directly attributable to acts, events, non-happenings, omissions, accidents or Acts of God beyond the reasonable control of the Company, Applicant or Broker (including, but not limited to, strikes, lock-outs or other labour disputes, civil commotion, riots, blockade, invasion, war, fire, explosion, sabotage, storm, epidemic, collision, fog, governmental act or regulation, major mechanical or electrical breakdown beyond the crew’s control)

Appointed Skipper

A certified and commercial endorsed skipper, with all in date certifications

Agreement

Payment
-
The Applicant shall agree to pay the deposit and all balances due by the dates outlined in the booking form.

Late payments may be subject to an additional admin fee of £50, at the discretion of the Company

Accidental Damage Payments
-
In the case of any damage or losses caused by the Applicant to the vessel or her equipment due to an act of negligence, the Applicant will be liable for the value of those losses or damages up to a maximum of £1,000

Cancellations or Amendments to Booking
-
The Applicant shall have the right to cancel in writing their booking no less than 30 days prior to the booking date. All payments paid will be held and can be allocated to a new booking.

The Applicant shall have the right to reschedule their booking no less than 30 days prior to the booking date. Any deposit paid will be used against the new booking.

The Applicant shall forfeit all payments made if cancellation is made within 30 days of the booking date.

In the event The Company needs to reschedule the booking for reasons other than Force Majeure, every effort will be made to move the booking date. If a mutually agreed date cannot be found within 12 months of the booking date, the balances paid shall be refunded.

In the event of severe weather or the decision of the Appointed Skipper to make necessary changes to the training plan, onboard training will be provided as an alternative

The Company’s Obligations

The Company shall provide a vessel, along with a certified and commercially endorsed skipper responsible for the vessel and all crew/applicants aboard for the duration of the booking

The Company shall not be liable for any loss or cancellations necessary before or during the booking period in the result of any acts outlined as Force Majeure.

Insurance and Liabilities

The Company warrants that the vessel and all her equipment shall be insured for the duration of the booking or charter.

The Company shall have no liability for death or injury suffered by the applicant unless caused by the Company’s negligence or wilful default.

The Company will appoint a certified and commercially endorsed skipper responsible for the vessel and all crew/applicants aboard

The Applicant shall be responsible for their own personal insurance to cover personal accident, medical, and emergency expenses, loss of baggage or personal effects, money, cancellations and travel disruptions.

Personal Data

On our Booking and Contact Forms, we require you to provide personal information such as name, address, email address, phone number, emergency contact details and medical details. We will only use your emergency contact details and medical details if you are injured or unwell during a Session. We will retain this information for future visits unless you tell us otherwise. If you provide credit or debit card details, we will use this information only for processing your payment.

Unless you tell us otherwise, we will use your name, address and, if provided, email address to provide you with information about our services and our news. You can opt out of this at any time. We will not release this information to anyone else.

Security​

​The Company takes every precaution to protect our users’ information. We use a number of digital security systems and operational procedures to protect data submitted to us by you. Physical security of data on our equipment is provided by a combination of firewalls and password protection. The Company uses all reasonable efforts to safeguard your personal information. However, you should be aware that the use of the Internet is not entirely secure and for this reason the Company cannot guarantee the security or integrity of any personal information which is transferred from you or to you via the Internet

Complaints

The Company tries to meet the highest standards when collecting and using personal information. We take any complaints we receive about this very seriously. We encourage people to bring it to our attention if they think that our collection or use of information is unfair, misleading or inappropriate. We would also welcome any suggestions for improving our procedures.

Sale of the Company

If the Company’s business is sold or integrated with another business your details may be disclosed to our advisers and any prospective purchasers and their advisers and will be passed on to the new owners of the business.
